Workers’ Comp class code 9402: Who Does It Apply To?

NY Workers’ Comp class code 9402 is applied to specialty contractors or municipality employees who are engaged in street cleaning. The cleaning may be performed either manually or mechanically. This may include mechanical sweepers that direct a spray onto street surfaces and rotary brooms that sweep dirt and other debris into storage bins. Streets may also be cleaned using water sprinkling trucks, in which the water carries the dirt to the curb and the water and dirt drains into sewers. Workers’ Comp class code 9402 also applies to insureds who clean mainline sewers and storm sewers where debris from the street is likely to accumulate.
Workers’ Comp class code 9402 applies to insureds who clear snow from public or private parking lots, streets or roads. Other operations that are included under NY Workers’ Comp class code 9402 include the power sweeping of parking lots, beach or shoreline cleaning, and cesspool or septic tank cleaning. Insureds that rent, deliver, install and service portable toilets are also included under NY Workers’ Comp class code 9402. The outdoor spraying for insect control that does not take place at farms or irrigation systems applies to NY Workers’ Comp class code 9402. If the spraying takes place on farms or irrigation systems, they are included under class code 0050. Aerial application of insecticides is included under class code 7420.
