NY Workers’ Comp class code 8209 applies to insureds engaged in vegetable packing, including drivers. The operations associated with NY Workers’ Comp class code 8209 are generally seasonal and involve buyers who go to farms and arrange to purchase the farmers’ vegetable crops in bulk. During harvest time, employees collect the vegetables picked by the farmers’ crews and bring the produce to a central location. Additional employees included under NY Workers’ Comp class code 8209 sort, grade, pack, or otherwise prepare the vegetables for transportation to market. NY Workers’ Comp class code 8209 is also applied to insureds that contract to perform vacuum tube processing of packed vegetables. This involves cases or cartons of vegetables that are stacked, moved into a vacuum tube, refrigerated or dehydrated, then removed and conveyed to waiting for railroad cars and/or trucks for delivery to buyers.
