Workers’ Comp class code 5223 applies to insureds engaged in the construction of all types of swimming pools. This includes municipal, commercial, or residential. All operations necessary for the construction of both in-ground and above-ground pools as well as the construction or installation of accompanying accessories are included under NY Workers’ Comp class code 5223. Basic construction varies and can include the use of poured concrete, gunite, dry pack, concrete block, brick, aluminum, fiberglass and wood. Vinyl liners may also be used with any basic design. NY Workers’ Comp class code 5223 also applies to all shop work done as a means of ensuring the completion of the pool at the selected site.

NY Workers’ Comp class code 5223 does not include iron or steel pool construction. These operations are instead included under class code 5069. Any excavation is also separately rated under class code 6217. Any maintenance work is included under class code 9030 as long as the operations are conducted with no interchange of labor with separate payroll records maintained from NY Workers’ Comp class code 5223. An insured who exclusively performs pool maintenance is separately rated under class code 9014.
