NY Workers’ Comp Class Code 5190: Who Does It Apply To?

NY Workers’ Comp class code 5190 applies to insureds that install electrical wiring systems within buildings. There is no restriction as to the capacity of such wiring systems from an electrical standpoint, and the class code applies to power circuitry as well as wiring for lighting purposes. The wiring may be hung on insulators or encased in rigid or flexible conduits, etc. NY Workers’ Comp class code 5190 also includes the installation or repair of fixtures or appliances. Small electrical fixture installation, such as fuses, plugs, or snap switches, is also included under NY Workers’ Comp class code 5190.

NY Workers’ Comp class code 5190 also applies to insureds who perform the electrical wiring for the installation of commercial sewing machines or satellite dish installations. The cleaning, oiling, or adjusting of a refrigeration unit in conjunction with an air conditioning unit is included under class code 5537. Simiarly, the cleaning, oiling, or adjusting of a refrigeration unit is rated to class code 9519. The incidental installation or repair of electrical apparatus is included under NY Workers’ Comp class code 5190 only when it is in connection with 5190 operations and done at the same location by the same contractor who performs the electrical wiring operations. If not, these operations are included under class code 3724.

The rate for NY Workers’ Comp class code 5190 increased 10.7% in 2013. While it was 5.49 in both 2011 and 2012, the rate for NY Workers’ Comp class code 5190 increased to 6.08 effective October 1, 2013. This increase means employers whose operations apply to NY Workers’ Comp class code 5190 will see more expensive pricing for their Workers’ Compensation policies in the 2013-2014 policy term.
