NY Workers’ Comp class code 0042: Landscaping applies to insureds that plan, clear, grade, and plant for landscaping operations. This also includes grass cutting, weed control, lawn spraying, laying out grounds, tree spraying or fumigating, and planting trees, shrubs, flowers or lawns. The sodding, seeding, planting, and similar work necessary for the beautification of roadsides in connection with street or road construction is also covered under NY Workers’ Comp class code 0042. Insureds classified under NY Workers’ Comp class code 0042 may have nursery operations, but this work is limited and conducted in order to stock their landscaping business.
NY, CT, NJ and PA Workers’ Comp class code 0042 is applied to insureds engaged in work involving new landscaping installations. Any work involving the maintenance of existing landscaping and/or lawn maintenance is classified under NY Workers’ Comp class code 9102. NY Workers’ Comp class code 0042 also applies to insureds installing the artificial turf. The installation of artificial turf for patios and related areas applies to class code 5478. Similarly, the preparation of the ground’s surface for artificial turf installation is covered under NY Workers’ Comp class code 5506. Insureds primarily engaged in excavation, filling, or backfilling are rated under class code 6217. Tree pruning, repairing, and trimming operations are classified under NY Workers’ Comp class code 0106.

The rate for NY Workers’ Comp class code 0042 decreased 7.3% in 2013. While it was 6.87 in 2012, the rate for NY Workers’ Comp class code 0042 decreased to 6.37 effective October 1, 2013. This decrease means employers whose operations apply to NY Workers’ Comp class code 0042 will see better pricing for their Workers’ Compensation policies in the 2013-2014 policy term.
