Workers’ Comp class code 7380: Who Does It Apply To?

NY Workers’ Comp class code 7380 applies to commercial drivers, chauffeurs, messengers, and their helpers. This class code is designated by NOC, which means that it only applies when the operations cannot otherwise be classified in the Basic Manual. “Drivers” refers to employees who engage in duties on or in connection with vehicles and include drivers, chauffeurs, messengers, drivers’ helpers, garage employees, stable hands, and employees using bicycles. NY Workers’ Comp class code 7380 is applied to insureds who drive vehicles and/or the transport goods that they own.

NY Workers’ Comp class code 7380 does not apply to drivers employed by insureds who are engaged in the business of transporting the public. Chauffeurs who are included under NY Workers’ Comp class code 7380 are drivers who are not employed by a risk classified as a public transportation operation but who may transport people. Messengers or couriers who deliver mail, parcels, or packages by driving or bicycling are also included under NY Workers’ Comp class code 7380. NY Workers’ Comp class code 7380 is also applied to school bus drivers that are employed by school districts and operate their own buses, traveling receipts collectors of highway toll roads, mobile food or ice cream vendors, and bookmobile drivers.
